Right of Withdrawal for Consumers

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, craft or profession.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day:

  • on which you, or a third party designated by you who is not the carrier, take physical possession of the goods, where you have ordered one or more goods as part of a single order and the goods are delivered together;
  • on which you, or a third party designated by you who is not the carrier, take physical possession of the last item, where you have ordered several goods as part of a single order and the goods are delivered separately;
  • on which you, or a third party designated by you who is not the carrier, take physical possession of the final partial shipment or the final item, where goods are delivered in several partial shipments or pieces.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement, for example by email, by letter sent by post or through the electronic withdrawal function provided on our website.

You may use the model withdrawal form provided below, but its use is not mandatory.

You may also exercise your right of withdrawal through the electronic withdrawal function labelled “Withdraw from contract here” on our website.

Where you submit your withdrawal electronically, we will send you confirmation of receipt without undue delay by email or another durable electronic medium.

To meet the withdrawal deadline, it is sufficient for you to send your notice concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the cost of the least expensive standard delivery method offered by us.

Additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us will not be reimbursed.

We will make the reimbursement without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal.

We will use the same payment method that you used for the original transaction unless expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the returned goods or until you have provided evidence that you have returned the goods, whichever occurs first.

Returning the Goods

Once we have received your withdrawal notice, we will provide you with the return address applicable to your order and the relevant return instructions without undue delay by email.

The return address may vary depending on the product and the fulfilment location from which your order was shipped.

You must return the goods without undue delay and no later than 14 days from the day on which you informed us of your decision to withdraw from the contract.

The return deadline is met if you send the goods before the 14-day return period has expired.

You are responsible for the direct cost of returning the goods.

Providing the applicable return address and return instructions is solely intended to ensure that your return is sent to the correct location.

Your withdrawal does not require our approval and is not dependent on receiving a return authorisation or return number.

Please do not send goods directly to our production or fulfilment partner unless the return instructions provided by us expressly ask you to do so.

Please include your order number inside the parcel so that we can identify and process your return. Failure to include the order number does not affect your statutory right of withdrawal but may delay the processing of your return.

We recommend retaining proof of postage until your return and reimbursement have been completed.

Loss in Value

You are only responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

You may inspect and try on clothing in the same way as you would in a physical shop.

Wearing, washing, staining, damaging or otherwise using the goods beyond what is necessary for such inspection may result in an appropriate deduction from the reimbursement where permitted by law.

Print-on-Demand and Made-to-Order Products

Most POCUS products are printed or embroidered only after an order has been placed. This allows us to avoid unnecessary overproduction.

The fact that a standard product is manufactured, printed or embroidered after an order has been placed does not, by itself, exclude the statutory right of withdrawal.

The right of withdrawal therefore applies to standard POCUS products where customers select from the sizes, colours, garments and designs offered in our online shop.

Personalised and Custom-Made Products

The right of withdrawal does not apply to goods that are not prefabricated and are produced according to an individual choice or specification made by the customer, or that are clearly personalised or specifically tailored to the customer’s personal requirements.

This includes, in particular:

  • garments printed or embroidered with a customer’s name or initials;
  • garments containing wording or personal messages supplied by the customer;
  • garments produced using artwork, photographs, logos or files supplied or uploaded by the customer;
  • customer-specific designs that are not part of our standard product range;
  • products individually altered or manufactured according to measurements or other personal specifications supplied by the customer.

Selecting a standard product, size, colour, garment or POCUS design from the options offered in our online shop does not constitute personalisation.

Faulty, Damaged or Incorrect Goods

The exclusion of the right of withdrawal for personalised or custom-made products does not affect your statutory rights where goods are faulty, damaged, incorrectly printed or embroidered, not as described or where you have received the wrong product.

Please include your order number and, where possible, photographs clearly showing the issue.

Where goods do not conform to the contract, your statutory consumer guarantee rights remain unaffected.

Necessary return costs for faulty, damaged or incorrectly supplied goods will be borne by us in accordance with applicable law.
